Thank you for choosing Roof Elixir, a roof rejuvenation treatment powered by Fresh Roof’s GreenSoy Technology, offered through Hayden & Associates, LLC d/b/a On Demand Construction Services (“we,” “us,” “our,” or “the Company”). These Terms of Service (“Terms”) govern your use of our website located at https://roofelixir.com/ (“Site”), and any products or services we provide (collectively, “Services”).

2. Services Description

Roof Elixir is our proprietary roof rejuvenation treatment, powered by Fresh Roof’s GreenSoy Technology, designed to extend the life of asphalt shingles without voiding the shingle manufacturer’s warranty. We provide:

  • Application of Roof Elixir to existing asphalt shingles.
  • A comprehensive six-year warranty following each treatment (subject to the terms described in Section 7).
  • Guidance on proper maintenance and upkeep for extended roof life.

3. Acceptance of Terms

By visiting our Site, purchasing, or otherwise using our Services, you agree to these Terms. If you do not agree with any part of these Terms, you must discontinue use of our Site and Services. Continued use indicates your acceptance and agreement.

4. Payment Terms

  • Pricing: Fees for Roof Elixir treatments vary depending on the scope of work. Your representative (“rep”) will provide you with a quote or invoice.
  • Payment Methods: We accept cash, check, money order, credit card, and financing through Enhancify™. Specific payment plans may be arranged with your rep, including one-time payments, invoices, or financing.
  • No Refunds: Roof Elixir is a treatment service and is not eligible for refunds once applied.

5. Intellectual Property

  • The Roof Elixir name, logo, website design, images, text, graphics, and other content (collectively, “Content”) are owned by or licensed to Hayden & Associates, LLC (d/b/a On Demand Construction Services).
  • You may not reproduce, distribute, modify, create derivative works of, publicly display, or transmit any Content from our Site or materials without our prior written permission.

6. User Conduct and Responsibilities

By using our Site or Services, you agree:

  • To use the Site only for lawful purposes and in accordance with these Terms.
  • Not to engage in any conduct that restricts or inhibits anyone else’s use of the Site or Services.
  • Not to misrepresent any personal or payment information provided to us or our financing partners.

7. Warranty Coverage and Limitations

  1. Six-Year Warranty
    Each Roof Elixir application includes a six-year limited warranty, provided by Fresh Roof LLC. This warranty ensures that the integrity of your shingles is maintained under normal circumstances.
  2. Warranty Transferability
    • The warranty is transferable and tied to the home address where the treatment was applied, rather than to the individual owner.
  3. Warranty Registration
    • To activate your warranty, you must submit your warranty information to your Roof Elixir representative. Upon completion, the final warranty documentation will be mailed to Roof Elixir and subsequently provided to you.
  4. Warranty Exclusions
    • The warranty does not cover accidents, neglect, natural disasters, structural defects unrelated to Roof Elixir, or improper application by anyone other than us or an authorized representative.
    • Our liability is limited to providing replacement materials as necessary to restore the treated portion of the roof’s integrity. We do not cover any additional or incidental costs beyond replacement materials.
  5. Warranty Claim Procedure
    • You must submit any claim in writing within 30 days of discovering a potential defect.
    • We (or our authorized representative) must be granted access to inspect and verify the claim.

8. Privacy and Data Usage

  • Data Collection: Roof Elixir does not sell consumer data. We collect only the information necessary to perform and improve our Services.
  • Analytics: We use anonymous web data from Meta, Google, and similar platforms for analytical and advertising purposes.
  • Financing: If you opt for financing through Enhancify™, we will share the necessary information with them to process your financing application. This information is used solely for that purpose.

9. Disclaimer of Warranties

  • General Disclaimer: Except for the explicit six-year warranty described in Section 7, we make no other warranties or guarantees regarding the roof treatment.
  • Performance Variation: Shingle conditions, weather, and other factors can influence results. The effectiveness of Roof Elixir may vary based on circumstances beyond our control.

10. Limitation of Liability

  • To the fullest extent permitted by law, Hayden & Associates, LLC (d/b/a On Demand Construction Services) shall not be liable for indirect, incidental, punitive, or consequential damages, including but not limited to loss of profits or data, arising out of or related to your use of our Services or Site.
  • Our total liability is expressly limited to the cost of the replacement materials outlined in the warranty and does not include labor or incidental costs unless otherwise stated in a written agreement.

11. Modifications to the Terms

We reserve the right to update or change these Terms at any time. Any new or modified Terms will be posted at https://roofelixir.com/terms-of-service/. Your continued use of the Site or Services after any changes indicates your acceptance of the revised Terms.

12. Governing Law and Dispute Resolution

These Terms and any disputes arising from them are governed by the laws of the State of Michigan, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the courts located in Michigan, and you consent to the jurisdiction of those courts.

13. Offers and Promotions

  • Offers presented by our representatives or on our social media channels may have specific terms, usage limitations, and expiration dates.
  • Any exceptions or extensions are made solely at our discretion.

14. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
